That setting only determines if the checkbbox for the newsletter is checked by default on the registration page, but a user may uncheck it, we don't force anyone to opt in to newsletters.

Is the newsletter security configured such that the allowed roles is "All Users". Newsletters protected by roles are not visible options until after the user registers and is signed in to the site and is in an allowed role.

fyi, I was thinking about this today and I changed it for the next release so that newsletters marked as available to "Authenticated Users" role will also appear on the registration page since users are automatically added to this role upon registration. That way it will be possible to configure newsletters that are only available to site members but still allow the user to opt in as part of site registration.
